Wesley Girls Senior High School is facing a lawsuit alleging that the institution has systematically denied Muslim students the right to practice their faith.

The lawsuit, filed by Ghanaian citizen Sahfic Osman, contends that the school’s policies have prevented Muslim students from observing their religious practices, thereby infringing upon their constitutional rights.

The plaintiff is seeking several declarations from the court, including a ruling that the school’s policy prohibiting Muslim students from practicing their faith is inconsistent with the provisions of the 1992 Constitution.

Specifically, the plaintiff argues that the school’s policy compelling students to participate in a compulsory school religion in a public institution violates Articles 21(1) (b) (c) and Article 26 of the Constitution.

Furthermore, the plaintiff asserts that the limitations imposed on Muslim students by the school undermine their welfare and well-being, as guaranteed by international human rights law, particularly Article 33(5) of the Constitution of Ghana, 1992.

The plaintiff is also seeking a court order directing the Ghana Education Service to develop and implement constitutionally compliant guidelines regulating religious practices and observance in all public schools in Ghana.
